The Court Papers are the first step in the divorce proceedings. One individual files a request for a divorce, which usually has a request for other things as well. This written request is called a Complaint, and it is filed with the Court. A filing fee is paid to submit the papers to the Court with jurisdiction. The Complaint usually has a request for the Court to decide who will have custody of any minor children. There is typically a request for payment of an amount of money meant to pay for things for the children. This payment is called Child Support.
Usually, there is a request to divide any property the parties acquired while married. This request and process is called Equitable Distribution. New Jersey is an “equitable distribution” State. The Judge will equitably divide the marital assets. Some States are “community property” States, meaning that everything that the husband and wife own will be divided between them. California is notorious for movie stars getting divorced and having to give millions of dollars to their ex-spouse, which they had before they got married. New Jersey does not do this.
New Jersey divides up the assets the husband and the wife accumulated during their marriage. Everything either of them owned before they got married is exempt from being distributed. If one partner gets a gift or if possessions were owned before the marriage or inherited items during or before the marriage, they can lose this exemption. Mixing exempt assets with assets acquired during the marriage may cause a loss of that exemption.
The Answer and Counterclaim usually include a request to grant the divorce and make other decisions in the case. The Judge must provide the decision to terminate the marriage. Each spouse must understand the financials, asset values, income, and debts before agreeing.
